This Policy applies to all products, services, and websites offered by The Source (herein referred to as “Service”). Please note that the availability of any The Source applications on a social networking site, mobile or tablet device, internet television or other technology platform does not indicate any relationship or affiliation between The Source and such social networking site, mobile or tablet device, or internet television or other technology platform. Thus, your information will not be shared amongst non-affiliates and will be retained via this Policy by The Source.

1. Information we collect
a. Information you provide – When you use our Service, we may collect your device ID and certain device information such as Internet Protocol Address (IP Address). When you sign up for an account with The Source, we ask you for personal information (such as your name, e-mail address, phone number, shirt size, etc.). At the time you register as a paying member or during your free trial period for a paying membership, we also request credit card or other payment account information which we maintain in encrypted form on our secure servers. If you are signing up for a free account, we do not collect any credit card or payment information.
Upon creation of your account, you will become a user of the Service (herein after referred to as “User” or in plural form as “Users”)
All Users will be given a user profile on The Source Social, our yoga centric social network. Your user profile includes your posts and engagement with the Service since the day your account was created. By default, your User profile will be publicly viewable by other logged in Users with accounts of their own. The name you provided, and your username chosen will also be viewable to logged in users. If you chose to change your user profile settings to private, only your friends and administrators of The Source will be able to see your posts and engagements with the Service.
We keep all messages sent between Users encrypted and unseen by anyone else outside of the conversation between Users. No administrator will ever see your messages unless there is a formal complaint or legal obligation to. In the event that an administrator needs to review your messages, you will be notified with explanation as to why. After the review is finished, you will be notified again, and all future communications will be encrypted and unviewable unless another instance shall occur.
Messages are only allowed to be sent between established friends and you will not receive any unwanted message from any User that is not preapproved by you as a friend.
We also use your name, e-mail address and other information on our system to notify you of new product releases, service notifications, events, and to solicit your feedback and input. We also use your information, or a portion thereof, to send you marketing materials and/or The Source newsletters or other information The Source thinks you would be interested in, unless you notify The Source that you do not wish to receive such materials. Please contact us to request that you not be sent any or all of such information.
c. Activity Information – In order to provide the best possible service and to allow us to make certain internal reports and make recommendations, we collect aggregate information about the use of the Service, including information about users accessing the Website such as internet protocol addresses, browser type, browser language, referring/ exit pages and URLs, platform type, number of clicks, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time.
d. IP Address – An Internet Protocol (IP) Address is a number that is automatically assigned to your computer whenever you are using the Web. We retain your IP address in order to help us diagnose problems with our servers, to administer our Website, to help identify you, to gather broad anonymous demographic information – such as the number of visitors from a geographic area – to enforce compliance with the Website terms and conditions, or otherwise in order to protect our services, sites, customers, or others. We will not view your specific IP Address unless there is probable cause to do so via suspicion or accusation of violation to our terms and conditions or other behavior out of line with our code of conduct.
e. Log information – When you use the Service, our servers automatically record information that your browser sends whenever you visit a website. These server logs include information such as your web request, IP address, browser type, browser language, the date and time of your request and one or more cookies that uniquely identify your browser.
f. User communications – When you send an email or other communications to The Source, we retain those communications in order to process your inquiries, respond to your requests and improve our services.
g. Links – The Source presents links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of the Service.
2. Information Use and Sharing
a. Personal information – We use your personal information for the purposes described in this Policy and/or privacy notice for specific services. Such purposes include, but are not limited to:
- Sharing information to our business partners whom perform core services – such as hosting, billing, data storage, messaging and reporting services – related to the operation of the Website and Service.
b. Choices for personal information – When you sign up for the Service, we ask you to provide personal information. If we use this information in a manner different than those described in this Policy and/or in the specific service notices, then we will ask for your consent prior to such use.
If we propose to use personal information for any purposes other than those described in this Policy and/or in the specific service notices, and you decline, The Source will not be able to provide its Service to you.
c. Maintenance of personal information – You can access your information contained in The Source’s database by contacting us. If you believe any of your information is incorrect or needs updating, please let us know at the email address listed in this section. The Source will use reasonable efforts to correct your information and our records upon verification of the requested change. If you no longer wish to receive email notifications from The Source, please let us know by contacting us. In the text of your email, specify which notifications you no longer wish to receive and provide your exact name, email address and/or address so that we can do our best to ensure that you stop receiving the notifications that you no longer wish to receive. After such a request is received, The Source will use reasonable efforts to refrain from including you when sending such notifications to The Source’s visitors/users/customers.
Should you wish to receive your data back from The Source upon deletion of account and termination of association with the Service, we will gather all datapoints we have from you and export them before scrubbing our servers of your information and deliver it to you upon request.
We do not currently maintain any procedures for you to review the information that we collect about you outside of your User profile without a formal request of deletion and removal from the Service.
d. Retention of personal information – When you close or de-activate your account or if your account is otherwise terminated, we have the right, but not the obligation, to store your personal information, settings, saved and completed classes, friends, posts and engagements. This information will be encrypted and not viewable to the public or any User.
e. Information Security – We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal information.
We restrict access to personal information to The Source employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
However, please note that no data transmission over the Internet can be guaranteed to be 100% secure, so while The Source strives to protect your information, The Source cannot ensure or warrant the security of any information that you voluntarily give to The Source.
f. Accessing and updating personal information – When you use the Service, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we in some cases decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.
3. Media Shared Through the Service
a. Use of Media – The Source uses User provided media as part of The Source Social – our yoga-centric social network. Users can upload images and videos to post on The Source Social feed. on their User profile, or in User groups as well as in a reply to any post and/or a private message to another User.
b. Copyrights to Media – We ask that, prior to posting a piece of media content, that the User is the sole owner of the original content and there is no copyrighted material being shared to The Source Social. If a User does post media content without proper copyrights or permission to do so, that User will be considered in breach of our terms and conditions and will be dealt with appropriately and accordingly.
c. Storage of Media – For security purposes, all media shared through the Service is stored on our secure Amazon Web Service (AWS) servers. Upon upload of media content that piece of media will be given a unique URL destination where it will remain unless otherwise requested. The deletion of a post, comment or message with media attached is not equivalent to the deletion of the media from our AWS server however, your uploaded media can be deleted permanently from our AWS servers upon request.
d. Requesting Media Deletion – In order to delete your media permanently from our AWS server, “Contact” us below to start a formal process. Upon contact, we will ask specifically what content you wish to be deleted. Note that we need a specific request for each piece of media you wish to delete. There is not global deletion of specific User submitted media at this time and each piece of media needs to be deleted on a case by case basis. To request deletion of media, provide us with the Date the media was posted and where (The Source Social Feed, your User profile, private messaging with another User, etc.). If the request is to delete media sent to another User, your messages with that User will not be read in an effort to protect your privacy as stated in Section 1a above, however, the other User will be contacted and informed that a piece of content shared with them is no longer viewable due to deletion.
4. Website Areas Beyond The Source Yoga + Wellness’s Control
a. Third party links, co-brand relationships and public forums – In an attempt to provide increased value to our visitors, The Source may choose various third party websites to link to, link from, and frame within, the Website. The Source also may participate in co-branding and other relationships to offer e-commerce and other services and features to its Users. However, even if the third party is affiliated with The Source, we have no control over these linked sites, each of who have separate privacy policies and data collection practices independent of The Source. We have no responsibility or liability for these independent policies or actions, and are not responsible for the privacy practices or the content of any such websites. Please make sure you are comfortable with the privacy practices of every site you visit before providing the site with your personal information. These linked sites are only for your convenience and you therefore access them at your own risk.
We also may make chat rooms, comment sections and message boards available to you on the Website. Please remember that we cannot control the information that is shared by members and that anything you voluntarily provide in any public area of the Internet will be publicly available to other visitors on that website and potentially to other third parties. Thus, please note that you should always exercise caution when deciding to publicly disclose any of your personal information in these and similar areas.
Publicly viewable areas of our website are, but are not limited to, The Source Live chat room, all The Source Journal article comments, all Open Source Podcast comments, and The Source Shop comments and product reviews.
The Source Social Feed is not a publicly viewable region of our Website and anything posted to the feed, your social profile or any social group is only viewable by all members, Users that are your friends, and/or Users that are a member of the specific group you post in.
5. International Visitors
This section applies to those that visit our Website or use our Service from the European Economic Area and Switzerland.
Lawful Basis for Processing
The Source Yoga + Wellness processes personal information with your consent (e.g., when you agree that The Source may place cookies, or when The Source processes personal information submitted for specified purposes). On other occasions, The Source may process personal information when it needs to do this to fulfill a contract (for example, for billing purposes) or where required to do so by law.
If necessary, The Source may also process personal information when it is in The Source’s legitimate interests to do this (e.g., for customer service or fraud detection) and when these interests are not overridden by your data protection rights. Transfers of Personal Information
Please be aware that the personal information we collect may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location. If you are located outside of the United States, please be advised that we process and store personal information in the United States and your consent to this privacy notice represents your agreement to this processing.
You have a right to the following:
- To request access to the personal information we hold about you;
- To request that we rectify or erase your personal information;
- To request that we restrict or block the processing of your personal information;
- Under certain circumstances, to receive personal information about you that we store and transmit to another without hindrance from us, including requesting that we provide your personal information directly to another, i.e., a right to data portability; and
- Where we previously obtained your consent, to withdraw consent to processing your personal information.

Please be aware that The Source may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so. Additionally, you have the right to lodge a complaint against us. To do so, contact the supervisory authority in your country of residence.
We will process and store your personal information only for the period necessary to achieve the purpose of the storage, or as permitted by law. We will retain and use your personal information to the extent necessary to enforce our agreements. The criteria used to determine the period of storage of personal information is the respective statutory retention period or six years in the case of contracts. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract or the initiation of a contract or for other lawful purposes.

When we receive formal written complaints at this address, it is The Source’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal information that cannot be resolved between The Source and an individual.
7. Users Under 18
The Source’s content is not directed at users under eighteen (18) years of age, and if you provide information about yourself as a user of The Source, you are representing that you are at least eighteen (18) years of age. We do not knowingly collect personally identifiable information from anyone under eighteen (18) years of age, but if we do become aware of having collected personally identifiable information from a user who is younger than eighteen (18) years of age, we will remove such information from our files.
8. Changes To This Policy
This Policy may be amended from time to time, you should visit this page periodically to review any changes to the Policy. If we believe that the changes are material, The Source will let you know by doing one (or more) of the following: (i) posting the changes on or through the Website or Service, or (ii) sending you an email or message about the changes.
